9 U.S.C. § 2 — Validity, irrevocability, and enforcement of agreements to arbitrate

The provision making written arbitration agreements in contracts involving commerce valid, irrevocable and enforceable, save on grounds that exist at law or in equity for revoking any contract. It is the starting point for any accurate discussion of private religious arbitration in the United States.

What this document establishes

  • That arbitration agreements are generally enforceable under federal law on the same footing as other contracts.
  • That ordinary contract defences remain available against them.

What it does not establish

  • It does not give any arbitrator, religious or otherwise, the powers of a court.
  • It does not establish that a religious tribunal's decision is enforceable in a given case.
  • It says nothing specific about Islamic law.
